No justice for legal aid as Grayling ignores thousands of consultation responses

Blind Justice: In Tory-led Britain, it’s also deaf. And ignorant. In fact, can it really be described as ‘justice’ at all?

A story has appeared on the BBC News website, stating that elite barristers have joined the chorus of opposition to the government’s plan to cut legal aid for criminal cases by almost a quarter.

It states that the Treasury Counsel, a group appointed by the Attorney General to prosecute the most serious crimes, has followed the lead of the Bar Council and the Law Society in saying the plan to cut £220 million from the annual £1 billion legal aid budget is unsustainable.

This is accurate, but fails to address the most damning indictment against Chris Grayling and the Ministry of Justice in this matter.

According to the Treasury Counsel’s written response: “HM Government has indicated that it rejects or can ignore much of the content of the thousands of Consultation Responses, …particularly as to the future effect on the supply and quality of criminal advocacy services from the proposed changes to legal aid funding.”

It continues: “Criminal legal aid remuneration is identified as an appropriate target for ‘reduction’: this is based on a ‘belief’. The belief is that ‘further efficiency and cost savings in criminal legal aid remuneration” are both possible and sustainable’.”

This means that Chris Grayling and his cronies have decided to ignore evidence-based opposition to their plans because of an unfounded, unquantifiable “belief” that cutting funding will not affect the quality of the legal advice available in criminal cases.

If this matter were itself a court case, it could be settled with a simple question: When has this ever been proved in the past?

Can you think of any time when cutting budgets has not harmed a service – or actually improved it? Of course not.

The response – written by people who are appointed by the Coalition Government’s own Attorney General, let’s not forget, and who may therefore be taken as broadly sympathetic to its aims, continues: “The Minister of State said, ‘This is a comprehensive package of reform, based on extensive consultation. I believe it  offers value for the taxpayer, stability for the professions, and access to justice for all’… yet the Impact Assessment attached to the new Paper simply makes no attempt to evaluate or monetise the behavioural changes that will most certainly result from its proposals.

“The entirely obvious and predictable outcomes are lost quality and reduced supply. These are airbrushed in the Impact Assessment by repeated “steady state” assumptions. The behavioural changes are not then, uncertain. Neither will any steady state remain. They are, though, unpalatable; they will not improve the public interest.

“In a telling acknowledgment of this, the Ministry in its new consultation paper wholly abdicates its responsibility for this assessment by first making neutral assumptions and then asking the consultees what the impact will be. The Minister of State has lifted his telescope to his bad eye.”

The assessment of the Treasury Counsel is that cumulative changes since 1997, and a real terms cut of nearly half since 2007, mean Grayling’s proposals “will do significant harm to the operation of the criminal justice system… In particular, they will have both an adverse and disproportionate effect on the supply of such services by the acknowledged experts – the criminal Bar”.

Not only that, but the response says the cuts could be achieved in less harmful ways, such as “the proper working through of existing changes. Or, for example, in the proper letting and administration of government contracts for CJS services; court interpreters, custodians and other activities are telling examples of incompetent administration and wasting money – and these on services ancillary to the main process, that are provided by trading companies rather than professionally regulated people.”

In other words, allowing the market into the Criminal Justice Service (that’s the ‘CJS’ in the quotation) has lowered its quality and increased its cost.

The bottom line: “We consider that the proposed reductions, in whichever iteration, are unnecessary, have an effect much larger than claimed and will produce unsustainable results.” In terms of quality of service, it seems that it is the government’s proposals that are unaffordable.

The Attorney General himself, Dominic Grieve, indicated his own lack of enthusiasm for the proposals in a letter to the Bar Council in June. This accepted that opposition to the proposals cannot be explained away by self-interest, acknowledging that there is serious and principled opposition to the proposals which cannot be attributed to mere selfishness.

“Many… took the view that these proposals would cause the edifice to collapse,” he wrote, adding that he would continue to draw Grayling’s attention to the concerns that had been expressed to him.

It seems, considering the latest developments, that the Ministry of Justice not only has a bad eye but also a deaf ear.

What a shame its members are not speechless as well. For the sake of balance, here’s what a Ministry spokesperson had to say: “At around £2 billion a year we have one of the most expensive legal aid systems in the world and even after our changes would still have one of the most generous. We agree legal aid is a vital part of our justice system and that’s why we have to find efficiencies to ensure it remains sustainable and available to those most in need of a lawyer.

“We have engaged constructively and consistently with lawyers – including revising our proposals in response to their comments – and to allege we have not is re-writing history.”

Is it constructive for a government department to ignore evidence that it has specifically requested?

Is it consistent to run a consultation process, and then throw away the results because they don’t agree with ministers’ “belief”?

Of course not.

Grayling’s plans are ideologically-based and entirely unsupportable and should be laughed out of court.

Congratulations to Alan Milburn for completely destroying the Coalition government’s ‘Making work Pay’ policy.

It was always critically flawed, of course – how could it not be? It was based on the idea of reducing the money available to people on benefits, in order to make the amount taken home by working people seem like more.

Meanwhile, the real winners were company bosses and shareholders for whom the line ‘Making Work Pay’ is a complete misnomer. A shareholder takes home dividends after investing in a company. Such a person doesn’t do any work for that money at all!

Mr Milburn’s study focuses on working parents, according to the BBC’s report. This makes sense because social mobility is historically based on a child managing to achieve more than a parent.

For decades, Britons have been able to say, proudly, that each generation has been better-off than the last; now, the Conservative-led Coalition has reversed that trend. Working parents simply don’t earn enough to escape poverty and two-thirds of poor children are now from families in which at least one adult has a job.

Falling earnings and rising prices mean the situation is likely to worsen – and what the report doesn’t say (but we can infer), is that this is an intended consequence of government policy. David Cameron will not be thanking Mr Milburn for pointing this out.

Mr Milburn has recommended diverting money currently used to provide universal benefits to pensioners, so that the richest senior citizens would lose their free TV licences and winter fuel allowances, in order to relieve the burden on the poorest families.

But Mr Cameron, who knows that pensioners are more likely to vote than younger people (including working parents), won’t accept that. A spokesman told the BBC those benefits will be safeguarded until after the 2015 general election – in order, we can infer, to ensure that pensioners will vote Conservative.

At least this admission makes Cameron’s reasoning clear!

Some have chosen to lay the blame on Education. That’s right – with a capital ‘E’. Apparently, although Tony Blair was right to put the emphasis on education back in 1997, people just haven’t been interested in taking it up, along with the massive opportunities it offers to attain a comfortable life.

That just doesn’t ring true. Look at Yr Obdt Srvt. I left school with nine GCE ‘O’ Levels and three ‘A’ levels, went on to get a degree and then went beyond that to get a post-graduate qualification in Journalism (making me one of the few news reporters, these days, to have one).

I have never received more than poverty wages – even when I was editing a newspaper. But the effect I have on my surroundings is completely disproportionate to the money I have received – I recently wrote that when I left my last full-time newspaper job, that paper lost £300,000 per year as a result (according to my sources). This very site is currently rated 16th most influential political blog in the UK.

Yet I am as poor as a church mouse!

So Education is not the culprit – and putting teachers on performance-related pay is to chase Education up a blind alley. How would Special Needs teachers benefit from such a system? All pupils have a range of abilities and no two are the same, so how can performance-related pay ever be judged fairly? Suppose a teacher correctly realises that some pupils will never achieve academic excellence but that their talents lie in practical pursuits – should that teacher lose pay for trying to get the best result possible for those pupils? Of course not.

Once again we see government policy following the ‘divide and conquer’ pattern. ‘Take from the needy and give to the greedy’, as the slogan states.

And the flag of the conquering elite is the ‘Old School Tie’.

You’re on very shaky ground in Cameron’s Britain – if you weren’t at Eton.

The Tory share of the vote is dwindling – why is Labour chasing it?

One of the things that really rankled about Rachel Reeves’ attempt at Tory talk in yesterday’s Observer was the (observable) fact that she didn’t need to.

Why try to out-Tory the Conservatives when their share of the vote has been going down at every election – among a proportion of active voters that is – itself – reducing?

So in 1955, they managed to snag 49.6 per cent of the votes. In 2010 this had dropped to 36.1 per cent. Turnout was 76.8 per cent in the first instance and 65.1 in the second. They got 38 per cent of all available votes in 1955 and 23.5 per cent in 2010.

Some could point out that Labour’s share in 2010 was only 29 per cent – around 18.8 per cent of all available votes – but this just proves the point. Neoliberal New Labour were very close to the Conservatives in outlook and policy and most people in the UK don’t want that.

But Rachel Reeves indicated that these policies would continue on her watch, and that’s why people reacted so strongly against the Observer interview.

Perhaps Labour should have done some research on this. Yes, the party has its ‘Your Britain’ website, for members to bring forward ideas – but I’ve been there and didn’t like it. It seemed needlessly complicated, with efforts made to get people discussing particular policy areas at particular times when it would have been better to let people just say what they want – when they want – and sort it out at the receiving end.

Besides – that’s just for members. How much research has Labour done on the doorstep? What do people who aren’t aligned to either main political party want? That is where Labour will get its votes.

Even pointing to research by the polling organisations doesn’t help here. Ipsos-MORI famously polled more than 2,500 people about the benefit cap earlier this year, and Iain Duncan Smith was delighted to announce that a significant majority of respondents were in favour.

It was left to this very blog to break the news that only 21 per cent of those respondents knew enough about the cap to give an educated opinion. It would be informative to know how many – of all the respondents, not just the 21 per cent – were actually affected by it.

All of this is a great shame that may worsen into a missed opportunity. There are some terrific ideas around at the moment and all Rachel Reeves – and Labour as a whole – has to do is look around for them.

The Fabian Society website carried an article entitled Welcome to DWP the other day, in which most current proposals for reform of the system were rejected – which is a telling indictment of the state of the nation in itself. The stated reasons were that they would reduce the incomes of poor families (no thank you, Labour! You’re not going to out-Tory the Tories!) or fatally undermine universalism.

But among the ideas that were there, it was suggested Labour needs to reform individual benefits before setting its planned upper ceiling on the benefits budget. To that, I would add that the ceiling needs to be described as a proportion of a Labour government’s overall budget – not limited to a particular sum of money. This is the only way to keep it fair as inflation increases costs and devalues the pounds in our pockets, year on year.

Reducing unemployment, involuntary part time work and low pay by getting people into full-time jobs on a living wage could cut billions off the benefit bill (and boost the tax take at the same time).

For right now, the article stated, La Reeves needs to work on Labour’s perception problem – the false image created for it by an unsympathetic mass media, that it is ‘soft’ on benefits. This is based on misconceptions; only a quarter of social security goes on working-age people without jobs, and benefit fraud is – as has been explained ad absurdum on this site – miniscule.

Before the recession, Labour had cut the number of people out of work and really made work pay (with tax credits – not necessarily a great way forward, but a start – and these could be eased out of service as pressure was exerted on employers to adopt living wages). The social security budget was falling, not increasing. That’s what Rachel Reeves needs to be saying. Labour’s policies were working. The public has been misinformed. A new Labour government could create a winning formula again.

It could happen – if Labour stops being the Party of Plastic Tories and starts being the Party of the Worker once again.

One lie leads to another, as Iain ‘Returned To Unit’ Smith seems to have found out – now that he has started, he can’t stop for fear that he’ll be found out.

Tough. The evidence is available for all to see.

His latest attempt at hoodwinking the public is a press release, Public think benefit cap claimants should work or move, in which even the headline is a lie.

It aims to publicise the results of a survey by Ipsos-MORI, examining public attitudes to the cap. The survey was carried out among more than 2,000 people who were selected to be representative of the UK as a whole.

“The vast majority (70 per cent) of the public think people affected by the benefit cap should be prepared to find jobs or work more hours,” the piece begins. This is accurate, according to the survey being quoted – but it is based on the premise that the benefit cap should be set at £26,000 per year for a workless family, which is significantly lower than what was originally advertised by the DWP – the income of an average working family.

The DWP, imposing the cap, drummed up support by saying it would limit the amount workless families could receive to the same as the average income of a family in work, claiming that this was £26,000. In fact, a working family claiming all the benefits to which it is entitled can get £31,000 – so the cap means workless families are at least £5,000 per year worse-off, a huge gap of 16-17 per cent.

“Two-thirds (65 per cent) say they should be willing to move to a cheaper property,” the release claims – but the Ipsos-MORI report’s summary makes it clear that support for the policy drops to 44 per cent – a minority – and opposition rises to 26 per cent if it means those benefit claimants affected by the cap have to move to other areas to find more affordable accommodation.

The press release, which came out to support the government policy ‘Simplifying the welfare system and making sure work pays’, continues: “Independent research published today (10 October 2013) shows that 60 per cent support the cap even if it means that those affected have to take a job, regardless of the pay.” So now it seems that making work pay is not the objective; cutting wages is the real plan.

“The Ipsos MORI report finds around three-quarters of the public support the benefit cap in principle.” This, at least, is accurate and is no bad thing. Benefits should be lower than wages – they are a safety net that should enable people to carry on living while they find paying work. But in return, employers need to pay a living wage, ensuring that nobody in work has to claim any benefit at all. That, at the moment, is sorely lacking in the UK.

“58 per cent think that politicians needed to do more to reduce the welfare bill.” But they weren’t asked how they thought this should be done, or whether politicians were doing the right things.

“50 per cent think that benefits are too generous.” Among those who’ve received benefits this drops, but surprisingly only to 45 per cent. Among those who haven’t received benefits, 62 per cent thought them too generous.

“11 per cent think the benefits system is working effectively.” But they weren’t asked whether the Conservative-led Coalition was to blame for the poor performance.

At this point, the press release stops quoting statistics – but there is one further piece of evidence that people need to know. It relates to what the people who were surveyed knew about the benefit cap before they answered the questions.

Only 29 per cent knew even a fair amount about the cap before answering the survey’s questions. Of the rest, 42 per cent said they knew “just a little” about it, 18 per cent said they’d heard of it but knew nothing at all about it, and eight per cent had never even heard of it.

So this survey – put out by the DWP as a measure of public support for the Benefit Cap – is in fact a measure of public ignorance.

Why should anybody accept these findings as authoritative? How can we accept the 70 per cent view that people affected by the cap should be prepared to find jobs or work – that’s fewer than those who admitted they don’t know much about it!

In fact, none of these statistics can claim to be authoritative because only a tiny minority of those surveyed knew enough about the subject.

Now look at Iain Duncan Smith’s comment: “Today’s report makes it clear that the public support setting a limit on benefits and the successful delivery of the benefit cap shows we are committed to returning fairness to the welfare state.”

Lie. It shows that most of the public are ignorant about the limit. The successful delivery of a benefit cap set at 17 per cent less than average income shows that he is committed to returning unfairness to the benefit system.

“Claimants affected by the cap need to make decisions about work and housing and what they can afford, just as hardworking families do. We have made sure the support is there to help people back into work and the Benefit Cap and Universal Credit will ensure that work pays.”

Lie. The press release itself states that people are being pressurised into any work they can get – whether it pays or not. Support is not available to get people back into jobs because the jobs aren’t there. And Universal Credit does not work.

The release goes on to state: “Since claimants were first notified of the benefit cap in April 2012, Jobcentre Plus have helped around 16,500 potentially capped claimants into work.” The wording is very careful; notice no mention is made that they moved into work specifically to avoid the cap – Smith and others have been reprimanded over such claims in the past. But the context suggests that the benefit cap is what motivated these people to get jobs, and that is unsupportable as well.

What a shambles.
